Before 9 am this morning the City Clerk sent out an e-mail to interested parties with the following message, which we copy verbatim further below.
This case is highly irregular. Four city councillors walked out in protest of the meeting chair’s handling of a Public Hearing on May 24, 2016. (See “Gong Show”: Eyewitness report,” and “City’s Official Statement” with links) The meeting could not continue due to lack of quorum of City Council. A protest walk out by Councillors may have been unprecedented. We believe that City Council had the option of resuming the Public Hearing at a later date, but staff recommended voiding that portion of the meeting, and starting anew. The City Manager promised publicly to issue a statement explaining the exact legal justification. We watch for that. There were also some irregularities with the audio and video recording of the meeting, with the web video feed being cut during the most critical moments, and sections missing from what was eventually posted online.) This application continues to merit a high level of attention. Due process of government is an important matter and should stand up to public scrutiny.
Please note that the e-mail nor the rezoning page on the City website do not articulate clearly what is the status of previous interventions (persons who spoke or wrote to City Council). We will try to clarify that and report back here. A city official previously stated that correspondence sent to the May 24 Public Hearing will be carried forward to this new one, but that anyone who spoke will have to sign up if they wish to speak again, as their previous speeches will not be considered.)
